If you do not agree, you may not access or use the Services. These Terms constitute a legally binding agreement between you and Westbeck Trust Bank (‘we,’ ‘us,’ or ‘our’).

2. Eligibility

If you are using the Services on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

3. Account Registration

To access certain features of our Services, you must register for an account. When registering, you agree to:

  • Maintain and promptly update your account information
  • Maintain the security of your login credentials and not share them with others
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

5. Online and Mobile Banking

Use of our online and mobile banking services is subject to the following additional terms:

  • Electronic Fund Transfers: All electronic fund transfers initiated through our Services are subject to the Electronic Fund Transfer Act (Regulation E) and the terms of your account agreement
  • Transaction Limits: Transaction limits may apply to transfers, bill payments, and mobile deposits as disclosed in your account agreement
  • Processing Times: We are not liable for delays in processing transactions caused by system maintenance, third-party processing, or circumstances beyond our control
  • Bill Pay: You are responsible for scheduling payments with sufficient lead time. We are not liable for late fees or penalties resulting from late or failed bill payments due to insufficient funds or incorrect payee information
  • Mobile Deposit: Mobile deposits are subject to review and may be held in accordance with our Funds Availability Policy. You must retain the original check for 60 days after deposit

6. Intellectual Property

All content, features, and functionality of the Services — including but not limited to text, graphics, logos, icons, images, audio clips, software, and their compilation — are the exclusive property of Westbeck Trust Bank and are protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Services without our prior written consent.

7. Third-Party Links and Services

Our Services may contain links to third-party websites, applications, or services that are not owned or controlled by our bank. We do not endorse, guarantee, or assume responsibility for the accuracy, legality, or content of any third-party site or service. Your interactions with third parties are governed solely by those parties' terms and policies. We shall not be liable for any damage or loss arising from your use of third-party services.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WESTBECK TRUST BANK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

  • The Services will be uninterrupted, timely, secure, or error-free
  • The results obtained from the use of the Services will be accurate or reliable
  • Any errors in the Services will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, REGARDLESS OF THE LEGAL THEORY. This limitation applies even if we have been advised of the possibility of such damages. Nothing in these Terms limits liability for fraud, willful misconduct, or damages that cannot be limited under applicable law.

10. Indemnification

You agree to indemnify, defend, and hold harmless us and our directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — shall remain in effect.

Material changes will be communicated by posting the updated Terms on our website, sending an email notification, or providing notice through our Services. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
